Treasury proposes investment controls that could cover physical AI

Proposed; comments due December 7Recorded action: October 26, 2026

What happened

The Treasury Department published proposed Outbound Investment Security Program regulations on October 26, 2026. Written comments are due December 7, 2026.

How the proposal reaches physical AI

The proposal would prohibit certain covered U.S. investments involving foreign persons developing systems within its proposed 'super intelligence' category. Its definition explicitly includes embodied systems, with industrial, humanoid and quadruped robots, autonomous vehicles and unmanned systems as examples when they use such a system.

This is a proposed investment rule, not a final regulation or a general prohibition on owning, building or selling robots. Whether a transaction is covered depends on the proposal's definitions, country-of-concern scope and other conditions; the examples alone do not make every robotics company subject to a ban.
