What happened

The extended public-comment period closed August 5, 2026, on an FAA notice of proposed rulemaking for unmanned-aircraft flight restrictions near qualifying fixed-site facilities.

What the proposal would do

The proposal would establish an application and FAA-review process for standard or special drone flight restrictions near eligible facilities. Applicants would have to show that a restriction is needed for aviation safety, protection of people or property, national security, or homeland security, while the rule would identify operations permitted within a restriction.

The docket remains pending. Closing the comment period did not finalize the rule, create a flight restriction, or authorize facility owners to control the airspace above their property. FAA would need to issue a final rule before the proposed process takes effect.
